Expired Patent Research
We research expired patents to identify technical approaches that may inform product development. We organize relevant disclosures and available patent-status records for review with your independent patent counsel. An expired patent does not, by itself, establish freedom to operate.
Why Expired Patent Research Matters
Patent disclosures can be a useful source of technical knowledge, including approaches that deserve another look as products, materials, and markets change. Research into expired patents may help a team explore alternatives before committing to an implementation. The research question is what those disclosures teach and what the available records show, not whether a product is cleared for commercial use. Other active patents, related claims, and non-patent restrictions may still apply. Your independent patent counsel should evaluate the proposed implementation and relevant jurisdictions before you rely on a finding.
Our Research Approach
Research organized around your technical question, intended markets, and counsel's review needs.
Define the Research Question
Agree the technical functions, product constraints, and markets to investigate. Scope the work without assuming that any particular approach is available for use.
Search Relevant Disclosures
Locate potentially relevant patent documents and organize the technical approaches they describe. Separate the disclosure's teaching from any conclusion about enforceable rights.
Document Available Status Records
Record available expiration and fee-status information, its source, and the date consulted. Flag uncertainty and distinguish reported term expiration from a lapse that may be subject to reinstatement.
Note Related Records and Jurisdictions
Identify related patent records and jurisdiction differences within the agreed scope. Flag potentially relevant active rights for further review without treating the search as exhaustive.
Prepare a Research Brief for Counsel
Deliver relevant disclosures, technical summaries, sourced status notes, scope limitations, and questions for independent patent counsel. Legal conclusions and any freedom-to-operate opinion remain counsel's responsibility.
Industry Landscape
Expiration applies to particular patent rights in particular jurisdictions. It is not a blanket release of every right connected to a technology or product. Related or overlapping patents may remain active, and rights in another market may have a different status. A record showing a lapse for unpaid fees also needs care because reinstatement may be possible under applicable rules. Patent research does not address every other restriction, such as copyright, trademarks, contractual obligations, or regulatory requirements. Findings reflect the records available when consulted and should be reviewed again before a material commercial decision.
Key Coverage Areas & Applications
Product Architecture Exploration
Explore previously disclosed approaches when comparing technical options for a new product or a substantial redesign.
Mechanical and Manufacturing Research
Review historical disclosures relevant to mechanisms, production methods, or equipment as inputs to engineering evaluation.
Software and Systems Research
Investigate disclosed system approaches while keeping patent status separate from software copyright, contractual terms, and active third-party rights.
Alternative Implementation Research
Identify technical alternatives for discussion with engineering and counsel, without assuming that a change avoids infringement.
Market-Specific Status Review
Organize available records for selected jurisdictions and identify differences or gaps that need counsel's attention.
Research Before Further Development
Understand existing disclosures before investing in adaptations. Whether an improvement may be patentable is a separate question for counsel.

Our Credentials
Founded by James Borzilleri, named inventor and technology founder
James Borzilleri built this practice around a problem he met personally. He is a named inventor on an issued U.S. patent and on multiple pending U.S. patent applications, and working through that first filing himself showed him where the process tends to break: inventions that were never written down, records that arrive too thin for counsel to work from, and valuable work that leaves with the engineer who created it.
Rather than accept those gaps, he designed the technology and the working method behind Idea Partnership himself, then refined them across years of founding and advising technology companies in fintech and adjacent fields. The result is a repeatable way to turn what your team already builds, and what your roadmap still needs, into a documented invention record that patent counsel can file from.
Idea Partnership is not a law firm and does not provide legal advice, opinions, or patent filing or prosecution services. We work alongside each client's qualified patent counsel, who is responsible for all legal advice, opinions, drafting, filing, and prosecution.
